Terms and Conditions
Please ensure that you have read and understood all our terms and
conditions carefully prior to placing an order with us.</span >
These are provision of service pertaining to any estimate, invoice and/or
works carried out by Daniel Teal Groundworks Ltd, trading as DT Groundworks
registered in England under number 09343123, whose registered address is 1
Thorngate, Ten Yards Lane, Thornton, Bradford, BD13 3SD.
General Terms
Estimates:
Our estimate is subject to withdrawal, correction, and/or alteration
at any time prior to the acceptance of our offer. Any changes to the
estimate after acceptance will be communicated and justified to the
customer.All estimates and invoices detail VAT. If the rate of VAT changes
between the date of the estimate/invoice and the date of your payment,
we will adjust the VAT rate accordingly.
Payments:
Payment of invoices should be made immediately upon completion of work
unless another agreement is in place.We reserve the right to require payment of a deposit prior to
commencement of work.DT Groundworks accepts payment via bank transfer only.
Working Hours:
Standard working hours are 8:00 AM to 5:00 PM, Monday to Friday,
excluding Bank Holidays. Any works to be completed outside of these
hours require prior agreement between DT Groundworks and the customer.
Deposits:
Non-refundable deposits are required for special-order items like
septic tanks or sewage treatment plants.
Assumptions and Requirements
Site Conditions:
Estimates assume good ground conditions. If soft ground, undermining
occurs, or bedrock is encountered, the estimate may increase. Initial
site assessments will be conducted to minimize unexpected costs. No
allowances are made for obstructions found during excavation.
Access:
It is the customers responsibility to ensure access is given
throughout the works. Unobstructed hard road access for delivery
vehicles is required for the full duration of our works. Any
obstruction may incur an extra charge.Customers must ensure that access can be made to the premises/ areas
working i.e., removal of obstacles, walls, fences, trees shrubbery. If
the customer would like us to include for this in our estimate they
must state prior to works commencing.
Information:
Customers must provide necessary information and drawings in a timely
manner. Delays or incorrect information may incur additional charges.
Weather Conditions:
Adverse weather conditions such as temperatures below 4 degrees
Celsius, excessive rain, and/or high winds may cause delays. DT
Groundworks reserves the right to extend the contract duration in such
circumstances without incurrence of any financial penalty. Specific
conditions and maximum delay periods will be communicated.
Liability
Damage Responsibility:
DT Groundworks is not responsible for damage within the first 300mm of
ground level or adverse effects due to movement around the site.
However, we will exercise a high level of skill and care to minimize
such risks.
Cancellation:
DT Groundworks reserves the right to cancel works due to
unavailability of required personnel or materials, or due to events
outside our control. Any cancellation will be notified by email.

Closing Conditions
Payment Terms:
Payment of invoices should be made immediately upon completion of work
unless otherwise agreed in writing.
Feedback:
DT Groundworks welcomes customer feedback and complaints. A structured
process for handling complaints, including timelines for responses and
resolutions, will be in place.
Additional Considerations
Customer Responsibilities:
Customer responsibilities and potential consequences for
non-compliance will be clearly outlined to manage expectations and
reduce disputes.
Delays
Job Delays:
Any delays in the job caused by factors within the customer’s control,
such as failure to provide necessary information, access, or
facilities, may incur additional charges. These charges will be
communicated and justified to the customer.
Treatment Tank Installation
Treatment Tank Installation:
If a treatment system is being installed in place of an existing
system/tank, The footprint of the new system may be larger than the
existing. The customer is responsible for ensuring that the additional
footprint required is permissible for installation.
Confidentiality
Confidentiality:
Both parties agree to keep all information exchanged during the course
of the contract confidential. This includes, but is not limited to,
financial details, business practices, and any proprietary
information. This clause remains in effect even after the contract
ends.
Force Majeure
Force Majeure:
Neither party shall be liable for any failure to perform its
obligations under this contract if such failure is caused by
circumstances beyond its reasonable control, including but not limited
to natural disasters, acts of terrorism, war, or government actions.
In such cases, the affected party must notify the other party as soon
as possible.
Termination
Termination:
Either party may terminate the contract if the other party breaches
any material term of the contract and fails to remedy the breach
within a specified period after receiving written notice.
Additionally, either party may terminate the contract if the other
party becomes insolvent or enters into bankruptcy.
Indemnification
Indemnification:
The customer agrees to indemnify and hold DT Groundworks harmless from
any claims, damages, losses, and expenses arising out of or resulting
from the performance of the work, provided that such claims, damages,
losses, or expenses are attributable to bodily injury, sickness,
disease, or death, or to injury to or destruction of tangible
property, except to the extent caused by the negligence or willful
misconduct of DT Groundworks.
Insurance
Insurance:
DT Groundworks shall maintain adequate insurance coverage, including
public liability insurance, employer’s liability insurance, and
professional indemnity insurance. Proof of insurance will be provided
upon request.
Health and Safety
Health and Safety:
DT Groundworks will comply with all relevant health and safety
regulations and provide a safe working environment. The customer must
also ensure that the site complies with health and safety standards
and provide any necessary safety information to DT Groundworks.
Dispute Resolution
Dispute Resolution:
Any disputes arising out of or in connection with this contract shall
be resolved through negotiation between the parties. If the dispute
cannot be resolved through negotiation, it shall be referred to
mediation before any legal action is taken.
Governing Law
Governing Law:
This contract shall be governed by and construed in accordance with
the laws of England and Wales. Any legal proceedings arising out of or
in connection with this contract shall be brought in the courts of
England and Wales.
Entire Agreement
Entire Agreement:
This contract constitutes the entire agreement between the parties and
supersedes all prior agreements, understandings, and representations,
whether oral or written, relating to the subject matter of this
contract.
Severability
Severability:
If any provision of this contract is found to be invalid or
unenforceable, the remaining provisions shall continue in full force
and effect.
Amendments
Amendments:
Any amendments to this contract must be made in writing and signed by
both parties.
- Percolation Tests
- Percolation tests are chargeable regardless of the results. If a test fails
on the initial attempt, we reserve the right to discontinue the assessment
and to discontinue testing/ withdraw from the site.
- Planning permission and Building Regulations
- It is the sole responsibility of the customer to ensure that all necessary
planning permissions and approvals from Building Control are obtained prior
to the commencement of any works. DT Groundworks may, upon the customer’s
explicit request, assist in liaising with the relevant authorities and
support the application process. However, such assistance must be formally
instructed by the customer in writing. DT Groundworks accepts no liability
for any delays, penalties, or issues arising from the failure to obtain the
required permissions or approvals.
- Tank Empties
- As part of our estimates, we may include a tank empty in the scope of works.
The tank empty is based on the average emptying of up to 4,500Ls. Additional
emptying exceeding this amount will not be included in the estimate costs
and will be chargeable to the customer at the fee as per waste disposal
charges.
Pre-Survey Requirements
Before the survey commences, it is the responsibility of the individual booking the survey to ensure the following conditions are met:
- Permission has been granted for the survey to take place at the location of the system and all relevant connected areas.
- The property and location of the off-mains drainage system are accessible and provide adequate access for inspection.
- Any overgrowth, obstructions, or debris must be cleared prior to the survey.
- The unit lid must be accessible and capable of being safely removed.
Survey Duration and Scheduling
- The site survey is expected to take approximately 20 minutes.
- You will be allocated a one-hour time slot during which our surveyor will arrive on site. This time slot allows for flexibility in arrival time, not the duration of the survey.
- While we make every effort to attend surveys on time, unforeseen circumstances may occasionally cause delays. In such cases, we will notify you as soon as possible and reschedule the appointment at the earliest mutually convenient time.
- No refunds will be issued in the event of a delay or rescheduling due to circumstances beyond our control.
Follow-Up Visits
- Any subsequent request to revisit the site to address issues raised during the initial survey will be charged at 60% of the original survey cost.
Incomplete Surveys
- If we are unable to obtain all necessary information during our visit to complete a written report, we may request that the person responsible for booking the survey provides the required details.
- If this information is not provided upon request and we are unable to complete the report, no refund will be issued.
Liability Disclaimer
- DT Groundworks accepts no liability for any damage to the water treatment system incurred while gaining access to the tank.
- If the above conditions are not met and we are unable to complete the survey, no refund will be issued.
Payment Terms
- Full payment must be made prior to the survey.
- If you wish to upgrade from a verbal to a written survey, this can be arranged on-site and must be paid for immediately.
Report and Estimate Delivery
- If an estimate or written report is required following the survey, we aim to provide this within 7 working days of the site visit. This timeframe may vary depending on the complexity of the project, but we will keep you informed of any delays.
Compliance Findings
- If, upon completion of the survey, we determine that the existing system does not comply with the General Binding Rules, this does not affect the cost of the survey. The survey fee remains payable regardless of the outcome or findings.
By confirming your appointment, you acknowledge and accept these terms.
- CCTV Survey: The visual inspection of [e.g., drains, pipes, conduits, building structures] using specialist camera equipment to identify defects, blockages, or other issues.
- Report: The written or digital document or email detailing the findings of the CCTV Survey, often including still images and/or video footage.
- Site: The property or location where the services are to be carried out.
- Estimate: The written estimate provided by us detailing the scope of work and charges for the services.
- We will perform the CCTV Survey as described in our estimate. Any additional work requested outside of the initial scope may incur further charges and will require a revised Estimator separate agreement.
- Our services are limited to the visual inspection of the accessible areas. We are not responsible for identifying issues in inaccessible areas or those obscured by debris, water, or other obstructions that cannot be reasonably removed during the survey.
- The Report will be based solely on observations made at the time of the survey. We cannot guarantee that conditions will not change after the survey has been completed.
- Access: You must ensure clear and safe access to the site and the areas requiring surveying (e.g., manholes, access points, inspection chambers). Any delays or additional work caused by restricted access may be chargeable.
- Utilities: You are responsible for identifying and notifying us of the location of any underground services (e.g., gas, electricity, water, telecommunications) that may be impacted by the survey equipment. We will exercise reasonable care but will not be liable for damage to unmarked or incorrectly marked services.
- Information: You must provide us with all relevant information regarding the site and the purpose of the survey, including any known history of issues.
- Safety: You must ensure the site is safe for our operatives to work. We reserve the right to cease work if, in our opinion, the working environment is unsafe, and You may still be liable for charges incurred.
- Debris/Obstructions: While we will make reasonable efforts, you are responsible for ensuring that the areas to be surveyed are free from excessive debris, blockages, or high water levels that may prevent the effective operation of the CCTV equipment. Clearing of such obstructions may incur additional charges.
- The cost of the Services will be as detailed in our estimate.
- Payment is taken up front, prior to the commencement of works taking place.
- Accepted payment methods are via bank transfer or by card payment over the phone. Please note that we do not accept American Express.
- All prices quoted are exclusive of VAT, unless otherwise stated.
- CCTV surveys provide a visual assessment. They do not guarantee the structural integrity or long-term performance of the surveyed area.
- Findings are limited to what is visible to the camera. Certain defects (e.g., hairline cracks, external damage not visible internally) may not be detectable.
- The survey may not detect issues that are intermittent or occur under specific conditions not present during the survey.
- In instances of severe root ingress, significant structural collapse, or prohibitive levels of debris/silt accumulation within the pipework that render camera progression impossible, the survey may be aborted. In such cases, despite our best efforts to achieve camera passage, no refund will be issued for the Services as our operative’s time and specialist equipment will have been deployed to assess the feasibility of the survey.
- Upon completion of the survey, we will provide a summary of our findings and if necessary advisories.
- The Report is for Your use only and should not be relied upon by third parties without Our express written consent.
- We will exercise reasonable care and skill in performing the Services.
- Our total liability to You for any loss or damage arising out of or in connection with these Terms or the Services, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall be limited to the total amount paid by you for the Services.
- We shall not be liable for any indirect, consequential, or economic loss or damage, including but not limited to loss of profit, loss of business, or interruption to business.
- We are not liable for pre-existing defects or issues with the Site that are not directly caused by Our work.
- Nothing in these Terms excludes or limits Our liability for death or personal injury caused by Our negligence, or for fraud or fraudulent misrepresentation.
- If You cancel the Services within 24 hours of the scheduled start time, we reserve the right to not issue a refund.
- If We need to cancel or postpone due to unforeseen circumstances (e.g., equipment failure, adverse weather, operative illness), We will endeavor to reschedule the Services at the earliest mutually convenient time. We will not be liable for any costs or losses incurred by You due to such cancellation or postponement.
- We will collect and process personal data (such as contact information, site details, and potentially images/video footage) solely for the purpose of providing the Services, fulfilling our contractual obligations, and complying with legal requirements.
- We are committed to protecting your privacy and handling your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
- We implement appropriate technical and organisational measures to ensure the security and confidentiality of your personal data.
- These Terms shall be governed by and construed in accordance with the laws of England and Wales.
- Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England.
- Drain Surveys:
- Access: Specific clauses on ensuring clear access to manholes, rodding eyes, and other drain entry points.
- Flow/Water Levels: What happens if the drain is full of water or actively flowing, impeding the survey? Will jetting be required (and charged for)?
- Blockages: Will the survey address blockages, or only identify them? Is clearing blockages a separate service?
- Pre-cleaning: Is it assumed the drains will be pre-cleaned, or will this be done by the contractor (and charged)?
- Pipe Diameter/Material: Limitations on what pipes can be surveyed.
- WRC Standard: Whether the report will be compliant with the Water Research Centre (WRC) Manual of Sewer Condition Classification standards.
- Building/Structural Surveys:
- Scope of Access: Clearly defining which parts of the building or structure will be surveyed (e.g., wall cavities, roof spaces, inaccessible voids).
- Intrusive vs. Non-Intrusive: Whether the survey involves any destructive access.
- Scaffolding/Access Equipment: Who is responsible for providing and costing access equipment.
- Security System Surveys:
- Data Protection: Specific clauses regarding the handling and storage of any recorded footage, particularly if it involves personal data.
- System Vulnerabilities: Limitations on the survey’s ability to identify every potential security vulnerability.
